General Terms and Conditions

 

 

1. Scope of application of the General Terms and Conditions (GTC)

An agreement is concluded between Liechtensteiner Fussballverband (LFV) and the customer by the customer placing an order through the online shop and the credit card being charged / payment by means of PostFinance on the one hand and an order confirmation being sent and delivery of the ordered goods by the LFV on the other hand. The conditions set down hereunder apply for such purchasing agreement.

2. Order and delivery

Usually, delivery is made within four working days as of receipt of payment by the LFV. For customer-specific orders (e.g. printing of jerseys), the delivery time usually is seven to ten working days. These delivery times shall be deemed legally non-binding approximates. This includes but is not limited to the customer not being entitled to immediate withdrawal from the agreement if the delivery is not made within these times. Prior to withdrawal from the agreement, the LFV shall be set a reasonable respite of at least 20 days for supplementary performance. The LFV shall not be liable for delayed delivery or non-delivery.

The LFV is entitled to make partial deliveries if a part of the ordered goods is not or no longer available, for example.

Benefits and risks are transferred to the customer upon shipping.

3. Prices and payment conditions

The LFV charges CHF 10.00 per order for shipping and processing costs within Liechtenstein and Switzerland, CHF 20.00 within Europe and CHF 30.00 outside of Europe.

Orders can be paid with a valid credit card (MasterCard, Visa) or by means of PostFinance.

The prices published in the online shop include value-added tax to the legally applicable amount. Postage and shipping costs are invoiced separately.

The LFV reserves the right to change the prices of the offered goods at any time. However, the prices published in the online shop at the date the order was placed shall always apply for the customers.

4. Return and right to exchange

There is no right to return and exchange goods that

a) were produced according to the customer's specifications or are clearly tailored to the customer's personal needs (e.g. jerseys printed with the name and/or number of players of the LFV);

b) were delivered in sealed packaging and were opened by the customer (e.g. sealed book packaging or DVDs);

c) were already washed, worn or used otherwise by the customer;

d) were sold at a reduced price and are labelled accordingly;

e) are exempt from return due to a note made explicitly next to the goods in the online shop.

With the exception of the above cases, return or exchange of goods can be requested by the customer without limitations and without giving any reasons. Return or exchange must be made within eight calendar days as of receipt of the good(s) by return of the delivered items. In any case, a copy of the receipt must be included, and the customer shall bear postage and shipping costs for the return.

Only after the LFV has received the returned goods, either a replacement is delivered to the customer (exchange), the purchasing price is reimbursed (return) or a merchandise credit equivalent to the value of the returned goods is issued at the customer's discretion. If goods cannot be delivered any longer (e.g. goods sold out), the customer may only demand reimbursement of the purchasing price or issue of a merchandise credit.

5. Defects

All defects must be advised to the LFV in writing immediately upon receipt of the goods or at their discovery if such defect could not be found immediately upon receipt of the goods. If the notice of defect is not made in due time or proper form, any claims for liability for defects are excluded. After expiration of one year since conclusion of the purchasing agreement, any warranty for defects is excluded.

If notice of defects is made in due time, the LFV shall rectify the defect or provide supplementary performance by delivery of new goods at the customer's discretion unless the goods are no longer deliverable or the supplementary performance is associated with unreasonable expenses for the LFV. In such cases, the customer is entitled to withdraw from the purchasing agreement and demand reimbursement of the purchasing price or demand a merchandise credit equivalent to the price of the defective goods at their discretion.

6. Liability

Irrespective of the legal basis, the LFV shall only be liable for grossly negligent or wilfully caused damages. Any liability of the LFV is excluded to the legally admissible extent, including but not limited to liability for indirect or consequential damages, loss of profit or earnings.

Due to the technical characteristics of the Internet, customers must ensure safety of the systems, programs and files themselves. The LFV shall not be liable for interference of third parties in the system (e.g. worms, viruses, etc.) or misuse of the information disclosed by the customer.

7. Industrial property rights, data protection

Any and all logos, pictures and other images on the LFV's Internet page and in the online shop are protected by trademark or copyright law. Any use without the LFV's consent, including but not limited to unauthorised download of images, is prohibited and subject to civil or criminal prosecution.

For the LFV, compliance with applicable data protection law is a matter of course. The LFV uses the data within the scope of legal provisions, e.g. for handling of this agreement or to inform the customer of goods or services of the LFV, if applicable. The customer can object to the use or transmission of data for advertising or market or opinion research purposes at the LFV at any time by advising the LFV of such objection.

8. Written form

Oral agreements between the LFV and the customer shall not be applicable.

9. Applicable law and place of jurisdiction

The exclusive place of jurisdiction for possible disputes arising from the purchasing agreement between the LFV and the customer shall be Vaduz.

The agreement shall be subject to Liechtenstein law exclusively.
